An open letter to Attorney Rob Mubarak, counsel to the Wilton Town Board:

As you know, I have filed a grievance against you with the Wisconsin Office of Lawyer Regulation. Intake Investigator Cathe Hahn contacted me last week and told me to continue providing her with documentation of my concerns. 

A major concern of mine is the failure of the Wilton Town Board to establish a town plan commission as required by the town’s ordinance on nonmetallic mining. The ordinance states that a quarry permit application must be submitted first to the town plan commission. The town plan commission is supposed to meet and consider the permit application and invite the public to attend the meeting and comment on the application. And then the town plan commission makes a recommendation to the board.

When I asked you what happened to the town plan commission, you answered that the town board is the town plan commission. It seems to me that your job was to advise the Wilton Town Board on its obligation to form a town plan commission. I am investigating the claim that when Rick Irwin was the town board chair, he made a motion at a town board meeting to begin the process of forming a town plan commission a couple of years ago. The two other board members at the time, Jim Bever and Doug Brandau, failed to act on the motion, and the motion failed. If that is true, current board members Jim Bever and Doug Brandau failed to meet their obligation to form a town plan commission. 

I need to get the minutes for all of the Wilton Town Board meetings that mention quarry permit applications and a town plan commission. Town Clerk Becky Pitel has not responded to any of my requests for board meeting minutes. Would you be so kind as to instruct Becky Pitel to contact me to make arrangements for me to get copies of the meeting minutes mentioned above.
